Article 53 of GDPR: General Conditions For The Members of The Supervisory Authority
Article 53 of GDPR provides for the mechanics of how the members of the supervisory authorities should be appointed.
Appointment of supervisory authority members (Article 53(1) GDPR)
Each EU member state must appoint its supervisory authority members in a transparent way through their parliament, government, head of state or other independent body.
Qualification of supervisory authority members (Article 53(2) GDPR)
Each member of the supervisory authority must have the expertise, qualification and skills relating to data protection so they can successfully accomplish their duties.
End of supervisory authority member’s mandate (Article 53(3) GDPR)
A supervisory authority member’s mandate will end:
- When the term of their office expires
- If they resign
- When they are required to retire by law
Dismissal of a supervisory authority member (Article 53(4) GDPR)
A member of the supervisory authority can only be dismissed:
- Based on grounds of serious misconduct
- If the member no longer meets the conditions required to perform his or her duties
