Article 55 of GDPR lays out the competence of the supervisory authority.
Power and competence of the supervisory authority (Article 55(1) GDPR)
The power and competence of the supervisory authority stem from the powers granted to it under GDPR along with the tasks assigned to it by its own EU member state.
Competence for data processing by public authorities (Article 55(2) GDPR)
The supervisory authority has the competence to review and monitor data processing activities of public authorities relating to:
- Processing activities necessary for the compliance of a legal obligation by the data controller
- When it’s necessary for the interest of the public or in the exercise of an official authority vested in the controller
Non-competence relating to judicial courts (Article 55(3) GDPR)
GDPR specifically excludes the competence of the supervisory authority with respect to the monitoring of personal data relating to judicial courts acting in their judicial capacity.
