Article 97 of GDPR: Commission Reports
Article 97 of GDPR outlines the obligations of the Commission to issue reports on its evaluation and review of GDPR.
Reporting obligation every four years (Article 97(1) GDPR)
Every four years, the Commission must issue a report on its evaluation and review of GDPR.
The report must be submitted to the European Parliament and the Council and should be publicly available.
Evaluation by the Commission (Article 97(2) GDPR)
In its report, the Commission must evaluate:
- The manner personal data is transferred to third countries particularly with respect to transfers to countries subject to an adequacy decision (Article 97(2)(a) GDPR)
- The cooperation and consistency mechanism (Article 97(2)(b) GDPR)
Request for information (Article 97(3) GDPR)
To prepare its report, the Commission may request for information from each EU member state and supervisory authorities.
Consideration of other bodies (Article 97(4) GDPR)
In performing its evaluations and review, the Commission should take into consideration the positions and findings of the European Parliament, the Council and any other relevant body or source.
Proposal for GDPR amendment (Article 97(5) GDPR)
When necessary and in light of the most recent technological advancements, the Commission must submit proposals to amend the GDPR regulation.
